Technovate N.V.’s Acceptable Use Policy (AUP) outlines the rules and guidelines for using our Services in a lawful, ethical, and respectful manner.

All users of Technovate’s services (including hosting, email, AI agents, AR/VR platforms, and any other service we provide) must comply with this AUP.

By using our Services, you agree not to misuse them. Violation of this AUP can result in suspension or termination of your services, and in serious cases, we may report you to the appropriate authorities.

1. Prohibited Activities

You may not use Technovate’s Services to engage in activities that are illegal, harmful, or interfere with others’ use of our services. This includes, but is not limited to, the following prohibited actions:

• Illegal Purposes: Using our services for any purpose that violates local, national, or international laws or regulations. Examples include but are not limited to: disseminating or storing content that is obscene, defamatory, infringing, or constitutes child pornography (which is strictly illegal and will be reported) or engaging in unlawful transactions (such as fraudulent schemes or sales of illegal goods/services).
• Intellectual Property Infringement: Uploading, downloading, hosting, or otherwise transmitting any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party. For instance, you may not host pirated software, movies, music, or images on our servers, or use our software to scrape or steal others’ content without permission.
• Spamming and Messaging Abuse: Sending unsolicited bulk messages or spam. This includes mass emailing, SMS, or chat messages that are unsolicited, as well as running mailing-list addresses that do not follow opt-in/opt-out practices. You must comply with anti- spam laws (like CAN-SPAM Act, if applicable) when using our email or messaging services. Using our servers to send spam or phishing emails is strictly prohibited.
• Security Violations: Attempting to breach the security of any Technovate network, service, or other user’s accounts. Prohibited activities include port scanning, vulnerability scanning without authorization, attempting to bypass user authentication or security of any host, network or account (“hacking”), or planting malware, viruses, worms, or any code intended to disrupt or hijack software/hardware functionality. You may not use our services as a platform for launching denial-of-service (DDoS) attacks or other malicious hacking activities.
• Network Abuse: Any activities that interfere with the proper functioning of our services or others’ use of the internet. This covers things like deliberate high-volume network traffic (packet flooding, spam bots, cryptocurrency mining with excessive resource usage on a shared server without permission) that disrupts servers or networks. You must not operate servers open to abuse, such as open mail relays or open proxies, on our infrastructure.
• Harassment and Hate: Using our services to harass, bully, or threaten others. This includes sending abuse, threats, or stalking someone via email or any communications medium provided by our services. We also prohibit content that is hateful or discriminatory on the basis of race, ethnicity, gender, religion, sexual orientation, or other protected characteristics, especially if it incites violence or hatred. (Note: We respect free speech, but not speech that breaks the law or violates this policy by targeting individuals or groups for harm.)
• Fraudulent Activity: Engaging in deceptive practices or fraud. Examples: impersonating any person or entity (spoofing identities in emails or AI bots without consent), or forging headers or other identifiers to mislead others (phishing). You must not use our services in any manner related to fraudulent credit card transactions or financial scams.
• Unauthorized Data Collection: Scraping or harvesting information from our services or others’ websites in a manner that is not allowed. Also, using our AI or other tools to mass- collect personal data without consent is forbidden (and likely illegal under privacy laws like GDPR). If your use of our service involves personal data, you must ensure you have rights to that data.
• Excessive or Disruptive Use: For shared services (like shared hosting or communal AI resources), you must not monopolize system resources to the detriment of others. For example, you shouldn’t run scripts that consume excessive CPU or memory on a shared server continuously or use an AI agent to spam high-volume requests that degrade service for others. We may implement usage limits and you must respect them.
• Misuse of AI and AR Services: If you are using our RX-Agent or other AI services, you must not use them to generate disallowed content (e.g., to produce spam, deepfakes to harass, automated scams, or to knowingly output disinformation in a harmful way). For AR/VR, you must not create content using Augmentify that violates others’ rights or safety (e.g., overlaying someone’s private property with defamatory virtual graffiti visible to others). Use common sense and respect with these tools.

2. User Responsibilities

• Account Security: You are responsible for maintaining the security of your account credentials. Do not share your passwords or API keys. If you use our hosting or servers, you must keep your own systems secure (e.g., update your web applications to patch known vulnerabilities, use secure passwords, etc.). If your account is compromised due to negligence (like weak password or an outdated script that gets hacked and then sends spam), we may need to suspend the account until it’s resolved.
• Content Monitoring: As a customer, you are expected to monitor your content and usage. If you are hosting user-generated content (UGC) on a site we host, you should have moderation practices to remove any content that violates this AUP or the law once you become aware of it. While we are not the content police for you, if we are alerted to content on your site that violates our policies or the law, we will act (which could include notifying you to remove it, or direct removal if urgent or if you don’t respond).
• Compliance with Laws. It is your responsibility to understand and comply with the laws applicable to your use of our services and content. This includes data protection laws (if you collect personal data), e-commerce regulations (if selling goods), and export controls (don’t use our software or services to transmit controlled technologies to sanctioned countries, as that could violate export law). If your use of our service involves regulated data (like health records, credit card data, etc.), ensure you are using our service in a compliant manner (e.g., using encryption, not storing card data if not allowed, etc.).
• Respect for Others’ Use. You should use our shared services in a manner that does not negatively affect others. For example, if you’re on a shared hosting server, configure your site not to over-consume resources; if you’re using a collaborative environment, don’t delete or alter content that isn’t yours. Essentially, treat others’ usage and the common resources with respect.

3. System and Network Security

Violations of system or network security are prohibited and may result in criminal and civil liability.

Technovate will investigate incidents involving such violations and may involve and cooperate with law enforcement if a criminal violation is suspected. Examples (some overlaps with “Prohibited Activities” above):

• Unauthorized access to or use of Technovate systems, data, or accounts (a.k.a. hacking).
• Probing, scanning or testing the vulnerability of a system or network without proper authorization.
• Interference with service to any user, host or network (e.g., deliberate attempts to overload a service, mailbombing, etc.).
• Forging of any TCP/IP packet header or any part of the header information in any email or newsgroup posting (this is a specific example of spoofing and is illegal in many areas).

If you are in doubt whether your intended action might violate security or is permitted (for example, you’re a security researcher who wants to test our platform’s security), please contact us for clarification or to get explicit permission.

4. Email and Anti-Spam Requirements

If your service includes sending email (through our SMTP servers or email accounts we host for you), you must follow these rules:

• You must not send unsolicited bulk email. Period. “Unsolicited” means the recipient has not verifiably granted deliberate permission to receive the email.
• You must comply with opt-out requests promptly. If someone asks to be removed, do not email them again.
• Your email’s “From” and “Reply-To” fields must be truthful and not mislead as to origin. Emails should include valid contact information from/to the sender.
• You should include any legally required information (for instance, a physical address and unsubscribed link for commercial emails if required by law).
• No email you send via our services should have misleading subject lines, advertisements for illegal products, or false headers.
• If we get complaints about spam coming from your account or servers, we will investigate and may suspend your sending until resolved.

5. Consequences of Violations

Violating this AUP may lead to temporary or permanent account suspension, termination of services, or other remedial actions at our discretion. Specifically:

• For minor or first-time violations, we will often send a warning and work with you to ensure it doesn’t happen again (for example, we detect malware on your site – we’ll notify you to fix it).
• For serious violations (like hosting illegal content, launching attacks, or repeated violations), we may immediately suspend or terminate the offending service without notice. We may also delete any offending content or software from our servers.
• We will charge for any costs incurred by Technovate or others due to your violation. For example, if your actions cause us to be fined or to spend resources (like investigating spam or cleaning up after a hack), we reserve the right to charge those costs to you.
• Law Enforcement: Technovate may report any activity that we suspect violates any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties. We will cooperate with law enforcement agencies in any investigations of unlawful activities on our network or systems. This could include disclosing customer information to the extent legally required.

6. Reporting Violations

We encourage our community and the public to report any violations of this Acceptable Use Policy. If you become aware of any prohibited activities or content on Technovate’s services, please notify us immediately.

• Abuse Reports: Send details to [email protected]. Please include as much detail as possible, such as the IP address, URLs, involved, date/time of incident, and nature of the suspected violation. If possible, provide evidence (e.g., email headers of spam, screenshots of offending content, log excerpts).
• We will review all reports and take appropriate action. For privacy reasons, we may not always be able to report back the outcome but know that we take abuse reports seriously.
• If you are a customer and you suspect your account or resources have been compromised or are being used in violation, report it as well. For instance, if you find your website is suddenly hosting strange files, let us know – it might have been hacked.

7. Other Policies and Terms

This AUP is part of our overall Terms & Conditions and other policies. In case of any conflict between this AUP and other documents, we will interpret them in a consistent manner if possible; otherwise, the more specific policy will usually govern the specific issue.

For example, our Anti-Fraud and Anti-Corruption policies (below) cover specific obligations that may also intersect with acceptable use (like you can’t use our services to engage in fraud or corruption either). All these policies collectively govern your use of our services.

8. Amendments

Technovate may amend or update this Acceptable Use Policy from time to time to adapt to changing legal and threat landscapes. We will notify customers of significant changes (via email or dashboard notifications) and post the updated AUP on our website with a new effective date. It’s your responsibility to review and adhere to the current AUP. Continued use of the services after an update constitutes acceptance of the revised policy.
